PLEASE READ THIS END USER LICENSE AGREEMENT CAREFULLY BEFORE DOWNLOADING, INSTALLING, OR USING VOKAB. BY TAPPING "AGREE," DOWNLOADING, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT DOWNLOAD OR USE THE APP.

1. Parties

This End User License Agreement (“Agreement”) is a legal agreement between you (“User” or “you”) and ShiftedPixel (“Company,” “we,” “us,” or “our”), the developer of Vokab (the “App”). This Agreement governs your use of the App, which is distributed via the Apple App Store and Google Play Store.

2. License Grant

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device that you own or control, solely for your personal, non-commercial purposes.

This license does not include the right to:

  • Sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the App
  • Modify, translate, adapt, or create derivative works based upon the App
  • Reverse engineer, disassemble, decompile, or otherwise attempt to derive the source code of the App
  • Remove, alter, or obscure any proprietary notices on the App
  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations

3. Description of the App

Vokab is a vocabulary-building mobile application that allows users to save words they encounter in daily life and retain them through scientifically-backed spaced repetition techniques. Key features include:

  • Personal word library — users add their own words and meanings
  • Spaced repetition quiz system (AMR-2 algorithm) — adaptive quizzes based on user performance
  • Streak system — daily engagement tracking with freeze and recovery mechanics
  • AI-powered features — including Ask AI for contextual word explanations and example sentences
  • Gems — an in-app currency earned through usage and purchasable via in-app purchases
  • In-app advertising — interstitial ads shown to free users

4. In-App Purchases and Subscriptions

4.1 Gems

The App uses an in-app virtual currency called Gems. Gems can be earned through app activity (e.g., completing quizzes) or purchased directly through the App Store or Google Play Store. Gems may be used to:

  • Unfreeze a frozen streak (cost varies based on streak length and number of frozen days)
  • Unlock premium features within the App

All purchases are final. Gems have no real-world monetary value and cannot be refunded, exchanged for cash, or transferred between accounts.

4.2 Premium Features

The App offers free and premium tiers. Free users are subject to limitations including interstitial advertisements and quiz cooldown periods (one quiz per 4 hours). Premium features may be unlocked through in-app purchases processed by Apple or Google.

4.3 Billing

All payments are processed by Apple (via the App Store) or Google (via Google Play). Your purchase is subject to their respective payment terms. We do not collect or store your payment information.

5. Advertisements

The free version of the App displays third-party interstitial advertisements. These ads are served after certain user actions (e.g., adding words). Ad frequency and targeting may be based on general usage patterns and a resettable advertising identifier on your device. We do not sell your personal data to advertisers. No personal information is shared with third-party advertisers beyond what is disclosed in our Privacy Policy.

6. AI-Powered Features

Vokab includes features powered by artificial intelligence, including word explanations and example sentence generation. Please note:

  • AI-generated content is provided for educational assistance only and may not always be accurate
  • No personal user data is sent to AI services — queries are processed anonymously
  • AI features require an active internet connection
  • We reserve the right to modify, limit, or discontinue AI features at any time

7. Streak and Gem Mechanics

The App includes a streak system that tracks daily word-adding activity. The following rules apply:

  • A streak is created when at least one word is added per day
  • Missing a day freezes the streak; missing three consecutive days breaks it permanently
  • Frozen streaks may be recovered using Gems within a 10-day recovery window
  • Gem costs for streak recovery are calculated based on streak length and frozen days

We reserve the right to adjust streak rules, gem costs, and recovery mechanics at any time with or without prior notice. Virtual progress (streaks, gems, XP) has no monetary value and may be reset or modified at our discretion.

8. User Content

You may enter words, meanings, and related content into the App (“User Content”). You retain ownership of your User Content. By using the App, you grant us a limited license to store and process your User Content solely to provide the App’s functionality.

You agree not to enter User Content that is unlawful, offensive, defamatory, or infringing upon third-party rights. We reserve the right to remove any User Content that violates this Agreement.

9. Privacy and Data

Your use of the App is also governed by our Privacy Policy. Key points:

  • Word data is stored locally on your device and synced to our servers when you create an account
  • We do not share personal user data with AI services
  • Advertising identifiers may be used for ad delivery, not for personal profiling
  • We disclose how advertising data and user identifiers are used in our Privacy Policy in compliance with Apple App Store guidelines

By using the App, you consent to the data practices described in our Privacy Policy.

10. Intellectual Property

The App, including its design, algorithms (including the AMR-2 spaced repetition system), features, branding, and all related content, is the exclusive property of ShiftedPixel and is protected by applicable intellectual property laws. Nothing in this Agreement transfers ownership of any intellectual property to you.

11. Termination

This Agreement is effective until terminated. We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates this Agreement or is harmful to other users, us, or third parties.

Upon termination, you must cease all use of the App and delete all copies from your devices. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, and limitations of liability.

12. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE MAKE NO WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY AI-GENERATED CONTENT WITHIN THE APP.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SHIFTEDPIXEL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use of or inability to use the App
  • Any unauthorized access to or alteration of your data
  • Loss of streaks, gems, XP, or other in-app progress
  • Any bugs, errors, or interruptions in the App

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR USD $10.00, WHICHEVER IS GREATER.

14. Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

  • This Agreement is between you and ShiftedPixel only, not with Apple Inc. Apple is not responsible for the App or its content
  • Apple has no obligation to provide maintenance or support for the App
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation
  • Apple is not responsible for addressing any claims by you or any third party relating to the App
  • Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you

15. Updates and Changes to the App

We reserve the right to modify, update, or discontinue the App or any of its features at any time without prior notice. We may also update this Agreement from time to time. Continued use of the App after any such changes constitutes your acceptance of the new terms.

16. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which ShiftedPixel is registered, without regard to conflict of law principles. Any disputes arising under this Agreement shall be resolved in the courts of that jurisdiction.
